Application to acquire reserve land aims to rectify encroachment

Council is conducting community consultation on a request to acquire part of a reserve at Ocean Avenue, Slade Point, to resolve a long-standing encroachment.

The request has come from the owners of 40 Ocean Avenue to purchase about 69 square metres to rectify the encroachment of their dwelling into the reserve.

This encroachment has a long history, dating back to around 1979. The property has changed hands a couple of times since then.

The owners of 40 Ocean Avenue want to legalise their encroachment by purchasing the land they encroach upon.

The process to purchase is via an application to the Department of Natural Resources. Any such application needs to be supported by the trustee of the reserve, which in this instance is council.

The owners making the application are responsible for all costs associated with the process.

As this encroachment is extensive, council considers it appropriate to consult with the Slade Point community before any decision is made.

Other encroachments into this reserve exist. Council is seeking to understand how the community would like to see them resolved.
