Received a Parking Infringement Notice?

How to Pay My Fine

You have the following options to pay your parking fine by the due date.

Please note, failure to make payment by the due date may incur additional costs.

1. In Person

You can pay in person at any of our council's Customer Service Centres. Please ensure you take the notice and your payment for the full amount.

2. By Mail

Make cheques payable to “Mackay Regional Council” and mail to:

Receipts will not be issued unless requested. Do not send cash by mail. Payment is not deemed as made until your cheque is honoured. If you require a receipt, please complete your name and address in BLOCK LETTERS in the space provided on the notice and return to the address above.

3. By Telephone

Contact council on 1300 MACKAY (622 529) to be transferred to our electronic payment system and pay by credit card.

4. Online

Payment by credit card can be made via council’s online services and selecting Infringements.

5. Payment Plan

If your parking fine totals $200 or more and you are the owner or nominated driver, you may be eligible to pay by instalments. Payment plans are subject to approval.

View My Parking Fine

To view your parking fine and photos of your vehicle when the fine was issued, please use the online evidence portal.

You will need your vehicle registration number and your ticket number to access the portal.

Lost Parking Infringement Notice

If you did not receive your parking infringement notice, or if it has been lost or misplaced, please contact council on 1300 622 529 or visit one of our customer service centres to obtain the necessary details.

If the due date for the infringement has already passed, you will need to submit an appeal for any applicable late fees to be reviewed.

How to Nominate Another Driver

If you are the registered owner of the vehicle, but was not responsible for the offence, you can nominate another driver of the vehicle in the following circumstances

You were not in charge of the vehicle at the time

  • You will need to provide the name and address of the person that was in charge of the vehicle at the time of the incident.

The vehicle was sold

  • You will need to provide the date of the sale of the vehicle and the details of the person you sold it to.

The vehicle was stolen

  • You will need to provide a copy of the report of the agency that you reported the theft to e.g. Qld Police.

Please complete this statutory declaration and return to council via post or in person, before the due date on the fine.

If your declaration is received late, you may incur a penalty.

How to Appeal Your Fine

You may apply for a review of the decision to issue the infringement notice in accordance with the particular provision of the Local Law or State Act.

There is one stage to council’s appeal process and if you are unhappy with the decision, you may elect to go to court after the decision is provided to you. You may also avoid the appeal process entirely and elect to have a court hearing.

The appeal must be lodged before:

  • The fine has been paid.
  • The due date has passed.

Who Can Appeal

You can only appeal if you are:

  • The registered owner of the vehicle or driver of the vehicle at the time of the offence.
  • A person acting on behalf of the registered owner with their consent.
  • A person who has been declared as the nominated driver of the vehicle.

Circumstances of Appeal and Evidence Requirements

In order to lodge an appeal, only accepted forms of evidence will be taken into consideration.

An appeal submitted without the required supporting evidence cannot be assessed and will be disregarded.

A photo of the parking fine is not regarded as evidence.

1. Failing to Display Disabled Parking Permit

Evidence required: A copy/photo of a valid disabled parking permit and identification details identifying proof of ability to use the permit.

2. Police Car on Duty

Speak to your supervisor to find out how to appeal your fine.

3. Parking Machine/mackay Parking App Not Working

Evidence required: Provide a written statement that explains attempts to use other machines within the vicinity and use of other methods or payment, e.g., coins, card or Mackay Parking app.

4. Signs Defaced, Missing, Damaged or Facing the Wrong Way Through Vandalism or Obstructed by Trees

Evidence required: A clear photo showing the nature of the damaged sign and the surroundings, to identify the area.

5. Penalty Infringement Notice (Pin) Issued With Incorrect Details (Vehicle Make/registration Etc.)

Evidence required: Proof of incorrect details.

Note: Council may reissue the fine with the correct details.

6. Genuine Oversight Due to Mitigating Circumstances

Evidence required: Any photos or other information to support the argument of mitigating circumstances.

7. Vehicle Not in Control of Registered Owner

You can nominate another person using this form(PDF, 183KB).

8. Serious Medical Circumstances

Emergency department hospital attendance, family death, birth, palliative care etc meant that the offender could not have been expected to comply with the parking restriction.

Evidence required: A letter from attending doctor or hospital providing a time and date that corresponds with the incident.

9. Mechanical Breakdown

Evidence required: A tow truck receipt, RACQ receipt or mechanical report stating the date and time.

10. Financial Hardship

Evidence required: Provide bank statements/pensioner card etc.

Appeal Process

Internal Review

  1. You have 28 days from the date the ticket (PIN) was issued to lodge your appeal.
  2. The area of council that issued the ticket investigates your appeal.
  3. After the investigation, council sends you a letter advising if your PIN has been waived or whether it stands and must be paid.
  4. Your appeal can be lodged online or by completing this form and returning to the address provided on the form.

If your ticket is upheld after council’s Delegated Independent Officer has investigated your appeal and you disagree with this decision, you have two options:

  1. You can elect to have a court hearing.
  2. You can pay the fine and the matter is settled.

Court Hearing

  1. If your election for a court hearing is received within 28 days of the notice being issued or the appeal decision, a prosecution against you may be commenced in a Magistrates Court.
  2. Your election may be made by completing this form and returning to the address indicated on the form.
  3. You are responsible for obtaining your own legal advice before the court hearing.
  4. If found guilty of the offence you may be required to pay costs.
  5. If you do not appear on the date set for the hearing, the offence may be heard in your absence.
  6. This notice may be withdrawn before or after the penalty has been paid.
  7. If the notice is withdrawn before it is paid, a prosecution against you may be commenced in a Magistrates Court.
