Local Government Act 2009, section 29B(1)(b), (4)

On April 28, 2021, Mackay Regional Council resolved to make:

  • Amending Local Law No. 1 (Community and Environmental Management) 2021 (“ALL1”); and
  • Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2021 (“ASLL1”);

(collectively, “the New Amending Local Laws”).

The New Amending Local Laws amended the following existing local laws:

Purpose and general effect of ALL1:

The purpose and general effect of ALL1 is to amend Local Law No.3 (Community and Environmental Management) 2011 to:

  • amend superseded legislative references;
  • amend the circumstances in which Council can enforce matters relating to overgrown and unsightly allotments;
  • make miscellaneous clarifying changes.

Purpose and general effect of ASLL1

The purpose and general effect of ASLL1 is to amend:

  • Subordinate Local Law No. 1.4 (Installation of Advertising Devices) 2011 to:
  • amend requirements for particular definitions and prescribed criteria for installation, erection and display of advertising devices;
  • fix typographical errors and renumber; and
  • Subordinate Local Law No. 1.10 (Operation of Public Swimming Pools) 2011 to modify requirements for the operation of public swimming pools;
  • Subordinate Local Law No. 2 (Animal Management) 2011 to:
  • create additional dog off leash areas;
  • amend particular requirements for approvals to keep animals;
  • insert additional places at which animals are prohibited;
  • amend the minimum standards for keeping animals;
  • amend definitions;
  • Subordinate Local Law No. 3 (Local Government Controlled Areas, Facilities and Roads) 2011 to:
  • specify additional local government facilities;
  • correct typographical errors;
  • Subordinate Local Law No. 5 (Parking) 2011 to amend place names to reflect current naming conventions.

Inspection and purchase

A copy of the New Amending Local Laws, and the consolidated versions of the Local Laws and Subordinate Local Laws amended by the New Amending Local Laws, may be inspected and purchased at Council’s public office at Sir Albert Abbott Administration Building, 73 Gordon Street, Mackay.

A copy of the New Amending Local Laws may also be viewed by the public on the websites of Council and the Department of State Development, Infrastructure, Local Government and Planning.
