Frequent Use Permit Application to use a Park, Reserve or Foreshore on a Regular Basis - Picnic Companies

Terms & Conditions

  1. Applications are to be submitted a minimum of 30 days prior to the nominated date for approval to be considered.
  2. As a requirement of your approval, Mackay Regional Council (MRC) requires the business organisation/permit holder have public liability cover of an amount not less than Five Million Dollars ($5,000,000.00) as part of a standard public liability insurance policy. A copy of the public liability insurance policy will be required by Councils Parks Booking Officer before this application is approved.
  3. Public Liability insurance with a minimum of $5M coverage must be always current and supporting documents always updated.
  4. Should any fees or charges be applicable to this application, no letter of approval or permit authorisation will be issued until payment has been made.
  5. Upon approval, Specific Terms and Conditions applicable to the frequent use permit shall be provided to the Company with the letter of approval and permit signage.
  6. The issued permit must be displayed during each event/activity.
  7. The permit holder will indemnify and keep Mackay Regional Council indemnified for and against all damages, actions, suits, claims, costs and demands, which may be made or recovered against the Mackay Regional Council by any person whatsoever in respect to any loss, injury (including death) or damage sustained whilst upon the Mackay Regional Council’s premises.
  8. The approval holder is to take specific measures to protect the safety of persons who may be involved in, or affected by, the use or activity authorised under the approval.
  9. MRC are not obligated to ensure amenities are open & available for use where events are held outside of usual business hours.
  10. Underground infrastructure is present in many council parks. Under no circumstances are pegs or stakes are to be inserted in the ground.
  11. Nothing substantial that could cause damage to the park's surface or infrastructure such as lights, signs, or furniture, is allowed to be used.
  12. Noise restrictions: no loud music, loudspeakers or megaphones are to be used.
  13. The approval holder is to take all measures to ensure all glass and glass receptacles are to remain within the picnic area and should any breakages occur, all glass is to be thoroughly removed from site.
  14. The minimal amount of distance that must be kept from residential properties is 50 metres.
  15. Events/activities are not permitted to be set up at any time in Car Parks, stairways, or pathways.
  16. The permit holder shall be responsible for the behaviour of participants.
  17. The permit holder must comply with all applicable laws, council policies and guidelines.
  18. Any electrical equipment - cords, fittings, switches - used for this event is to be tested and tagged by qualified persons as per Australian Standards (AS/NZS 3760:2003).
  19. The class or activity must not cause any nuisance, disturbance, damage, inconvenience or obstruction to Council, residents, or members of the public.
  20. No bookings will be made for the open space, and Council offers no guarantee that the public open space will be available, and not already in use by another group or suitable for use.
  21. The activity must not interfere with any Council approved or booked events/activities or Council scheduled works; this includes but is not limited to - a Wedding, Birthday Party, Corporate BBQ, Sporting Activity, or upgrade or remediation works that is being carried out. The permit holder acknowledges that such a booking has priority over the event/activity use.
  22. Council may require access to the open space in relation to their usual activities. The permit holder will follow all direction given by an Authorised Council Officer that may require the permit holder to cease, move or relocate activities during the required time.
  23. The permit holder will:
    • leave all parks and gardens in a tidy condition and shall immediately remove all rubbish.
    • report any damage to council property immediately and repair any damage to council property, gardens, park surfaces, trees, or shrubs at their own expense.
    • Not sell clothing, equipment or refreshments or any other goods or product without first obtaining relevant vendor permits from Councils Health & Regulatory Department.
    • prior to commencing activities, inspect the area to ensure no hazards are evident and take appropriate action to remove any hazards or alternately move the event to a more suitable location.
  24. No items, signage or decorations are permitted to be attached or hung from trees under any circumstances. Decorations may be loosely tied to furniture, structures, and fences for the duration of the event/activity. The use of staples, nails, or tapes to attach decorations is not permitted. When vacating the area, the permit holder is responsible for ensuring all decorations are removed.
  25. It is the responsibility of the permit holder to remove the rubbish associated with each event/activity, and to ensure the area is left in the same condition as before the event commenced. Please note the hirer is responsible for the provision of extra bins where required & removal from site after event. Council reserves the right to recover financial costs associated with rubbish clean up and collection.
  26. Rice, confetti, glitter, rose petals, streamers and other manufactured products are not permitted in any park area or foreshore. Bubbles and leaves are an acceptable alternative; however, no residue is to remain on concrete pathways, wooden decks, or stepped access areas.
  27. Any damage caused wilfully or accidentally is the responsibility of the permit holder and Council reserves the right to recover financial costs associated with such damage.
  28. Vehicle access is permitted for set up and pack down of the event/activity. Vehicles are not to remain within the park.
  29. Where MRC incurs costs or expenses in rectifying any damage caused or contributed to by the approval holder or by the conduct of the approved use or activity, the approval holder will pay the amount of those costs or expenses to MRC.
  30. Consumption of Alcohol in public parks without Council approval is strictly prohibited under State Government Legislation. Alcohol is strictly prohibited under the permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party will be required.
  31. No amusements are authorised without Council approval and are strictly prohibited under this permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party will be required.
  32. No animal activity is authorised and is strictly prohibited under this permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party will be required.
  33. Weddings, Naming Ceremony’s, Corporate Events, or any event open to the public is prohibited under the permit and an application to use a Park, Reserve or Foreshore for a Wedding or Naming Ceremony will be required.
  34. Inflatable entertainment, live music/entertainment/amplification equipment is prohibited under the permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party will be required.
  35. Any booking exceeding 20 attendees is prohibited under the permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party will be required.
  36. Vendors/stall holders are prohibited under the permit and an application to use a Park, Reserve or Foreshore for a Private Social Event or Birthday Party or an application to use a Park, Reserve or Foreshore for a Community Social Event will be required.
